The Colorado State Patrol are actively seeking information on a car that struck a cyclist on Loveland Pass on the morning of July 4th, and fled the scene. The accident apparently happened around 9:30 a.m. in the morning near Arapahoe Basin Ski Resort. The cyclist was eastbound on U.S. Highway 6. He is a 52-year-old man from Fruita.
The cyclist was found by Summit Fire & EMS on the shoulder of the road unconscious, and said to have sustained significant injuries. He was transported to St. Anthony Summit Medical Center by ambulance, and is now in stable condition. Authorities believe the vehicle that struck him may be a 2011-2015 Ford Explorer that will show damage to the passenger side front fender.
Though the reason that the driver of the vehicle fled the scene is unknown at this time, it is possible that driving under the influence was a factor. However, even though he or she may have been charged with DUI had they of stayed on scene, they have likely brought additional charges upon themselves by leaving. Colorado law considers the act of leaving the scene of an accident where there is serious bodily injury a Class 4 felony carrying a sentence of two to six years in prison, and fines of $2,000 to $500,000. In addition, the injured cyclist may bring a personal injury lawsuit against the driver for medical bills and property damage.
As you can see, punishment for DUI is much less than punishment for leaving the scene of an accident, especially where injuries are involved.
