What Are Disorderly Conduct Charges?

If you are charged with disorderly conduct, you are facing either a Class 1 misdemeanor, Class 2 misdemeanor or Class 3 misdemeanor. Any level of these charges can carry a penalty of a monetary fine and/or jail time, with the most serious leaving you with the potential of up to a year in jail. Increased consequences apply in situations where you may have been charged with and convicted of a previous disorderly offense.

Using foul and offensive language in public, excessive noise near a residence, public fighting, disrupting a funeral and threatening to discharge (or discharging) a weapon are all examples of situations that may result in a disorderly conduct charge.

When Facing A Public Nuisance Arrest

In addition to general disorderly conduct, Colorado statutes detail a charge related to being a public nuisance. Behaviors that are legally classified under this statute include anything that disturbs the peace in a public area or other area where groups gather, or near a residential area, such as drug dealing, serving liquor to minors, illegal gambling, selling of stolen items or solicitation of prostitution.

Though a public nuisance charge is a Class 2 misdemeanor, the consequences are still severe and can include jail time, fines and a permanent criminal record as a result of a conviction.
